The shopkeeper instructed the shopkeeper to pay compensation

A District Consumer Commission directed the brand factory to pay Brand 10,000 as compensation for the lack of service.

It also ordered a refund of 8 74.98, which a complainant said the company had charged him as excessive GST, and had 10 which the company had charged for carry bags.

District Consumer Disputes Redressal Commission Hyderabad – I was dealing with a complaint filed against 29 years old Shrikhande Umesh Kumar, resident of Risala Abdullah, against the brand factory outlet in Parklane.

The complainant stated that he bought a pair of jeans which were at a 40% discount.

The maximum retail price was 99 2,499, which was included by the complainant GST, and after the discount, the price was 1,499.40, including GST.

But the outlet charged 94 1,594.38 from the complainant.

An additional amount of 8 74.88 was recovered as GST. The complainant also stated that a fee of ₹ 10 was charged for the carry bag, which had the logo of the outlet printed on it. He alleged that the company made its ‘advertising agent’ to the customers.

Meanwhile, the brand factory denied all the allegations, arguing that ‘GST will be determined on the basis of transaction value’.

The outlet stated that the value of the transaction was included in the GST and was the same with the calculation.

In relation to the charging, 10, it stated that a notice was prominently displayed, and that there was no lack of service.

Taking into account the evidence and arguments, the Commission mentioned that the complainant relied on a judgment which was made in a case related to Myntra Designs Pvt Ltd and Shrays Patel Pvt Ltd, stating that the additional GST charge Doing service is lacking.

With regard to carry-over, the Commission stated, “The opposite party has provided the said carry bag to the complainant. This should have informed the complainant before the selection of the goods, but not at the payment counter, as the action of the opposite party is certainly due to lack of service and also to adopt unfair trade practices. ”

Apart from ordering GST refunds and paying compensation, the commission imposed a cost of a 5,000.
