Prosecutors fail to appear in the case against terrorist-accused Thadientwide Nazer

With no ‘public prosecutor not appearing effectively’ in the case of Thadiyantved Nazir, a terrorist-accused in a special court of the National Investigation Agency, the court has sought to intervene with the district collector of Ernakulam to resolve the impulse.

The special judge, who gave a letter to the district collector, pointed out that no public prosecutor had been appearing effectively in the cases against Nazer for the last nine postings or more. The judge also asked the collector to give effective directions to the prosecutors in the case.

The court further stated that if some prosecutors appeared in the case, they were not ready to debate the cases which were mainly posted for hearing on framing of charges against the accused. The judge complained that the court was not even in a position to understand in which cases the prosecutor was appearing. Most of the cases were very old and the court may have to proceed as none of the prosecutors appeared in the cases, they complained.

The investigating agencies had alleged that Nazir had links with some extremist organizations and was involved in some terrorist activities in the country. The agencies had also slapped the Unlawful Activities Prevention Act against Nazar, who is currently imprisoned in Parappana Agrahara jail in Bangalore in some cases.

He has also been convicted as an accused and has been convicted in some terror cases.

Reacting to the developments, the district government thinker Manoj ji. Krishnan said that the issue did not come to his attention.

NIA court prosecutors have been removed from the pool of officers, as there are no special prosecutors for the special court. Since the outbreak of COVID-19, prosecutors have been appearing online in most cases. The presence of prosecutors went unnoticed due to technical glitches that could occur during the online process.

The special court may bring the issue to the attention of the Chief District and Sessions Judge, he said.

When contacted, district officials said that letters have been sent to prosecutors.
