    Apple Reaches USD 25 Million Settlement US Government Over ‘Discriminatory Hiring’ and ‘Job Bias’ Allegations

    New York, November 10: Apple Inc reached an agreement with the US Department of Justice (DOJ) to resolve allegations that the tech giant illegally discriminated in hiring and recruitment against American citizens and certain non-US citizens whose permission to live in and work in the country does not expire. Pursuant to the $25 million agreement, Apple is required to pay $6.75 million in civil penalties and establish an $18.25 million back pay fund for eligible discrimination victims.

    This is the largest award recovered under the anti-discrimination provision of the Immigration and Nationality Act (INA), the DOJ announced on Thursday. “Creating unlawful barriers that make it harder for someone to seek a job because of their citizenship status will not be tolerated,” said Assistant Attorney General Kristen Clarke of the Department’s Civil Rights Division. ChatGPT Down: AI Chatbot Back Online After Facing Global Outage, OpenAI Says DDoS Attack Behind Periodic Outages.

    “This resolution reflects the Civil Rights Division’s commitment to ending illegal discriminatory employment practices,” Clarke added. The settlement agreement resolves the department’s determination that Apple violated the INA’s anti-discrimination requirements during Apple’s recruitment for positions falling under the permanent labour certification program (PERM).

    The PERM program is administered by the Department of Labor and the Department of Homeland Security. It allows employers to sponsor workers for lawful permanent resident status in the US after completing recruitment and meeting other program requirements.

    Any US employer that utilizes the PERM program cannot illegally discriminate in hiring or recruitment based on citizenship or immigration status.

    The Department’s investigation, which started in February 2019, found that Apple engaged in a pattern or practice of citizenship status discrimination in recruitment for positions it hired through PERM. It also found that the company’s unlawful discrimination prejudiced US citizens, US nationals, lawful permanent residents, and those granted asylum or refugee status.

    These less effective recruitment practices deterred protected workers from applying to positions that Apple preferred to fill instead with PERM beneficiaries. Specifically, the department’s investigation found that Apple did not advertise positions Apple sought to fill through the PERM program on its external job website, even though its standard practice was to post other job positions on this website.

    It also required all PERM position applicants to mail paper applications, even though the company permitted electronic applications for other positions. In some instances, Apple did not consider certain applications for PERM positions from Apple employees if those applications were submitted electronically, as opposed to paper applications submitted through the mail.

    These less effective recruitment procedures nearly always resulted in few or no applications to PERM positions from applicants whose permission to work does not expire.     Specifically, Apple will be required to conduct more expansive recruitment for all PERM positions, including posting PERM positions on its external job website, accepting electronic applications, and enabling applicants to PERM positions to be searchable in its applicant tracking system. Additionally, Apple will train its employees on the INA’s anti-discrimination requirements and be subject to departmental monitoring for the three-year period of the agreement.

    In June, Musk had asked Tesla executives to “pause all hiring” and cut 10 per cent of staff, along with freezing hiring.     Tesla has communicated to some employees that it is stopping hiring for now. The company also said that teams will be expected to make layoffs during the “first quarter of 2023”. Tesla is facing pressures from its recent steep stock price drop, which began in late September, and got worsened with Musk’s $44 billion acquisition of Twitter.

    San Francisco, November 22: Chinese short-form video platform TikTok said that it would add about 3,000 engineers in locations across the world, including the US. According to The Wall Street Journal, as several of the world’s biggest tech companies are laying off employees, TikTok is in the middle of a three-year hiring push.

    “We have always been more cautious in terms of recruitment.     TikTok is also hiring at its major hub in Singapore, according to the report.     San Francisco/New Delhi, Nov 13: As thousands of techies lose jobs at Big Tech companies, most of them are finding it difficult to get jobs, as there is a freeze on new hirings at nearly every top firm, amid global macroeconomic conditions and recession fears.

    Indian-origin Nilesh Bhandare, 39, was a data engineer at Twitter. He told the San Francisco Chronicle that he has seen a dramatic turnaround in job availability in the market.

    “While lots of recruiters have approached him, only about 20 per cent are focused on full-time positions. The rest are seeking contract workers — who can more easily be let go,” the report said.

    The last time Bhandare scouted for jobs, the situation was entirely different.

    “My take is, no one wants to commit now for full time, because companies are not sure about the economic situation,” Bhandare was quoted as saying in the report.

    It’s an anxious time for tens of thousands of newly laid-off workers amid inflation pressures and recession concerns.

    “Data suggests San Francisco’s tech industry has been losing jobs for months,” the report mentioned.

    In January, there were 41,718 tech job listings in the San Francisco-Oakland-Fremont metro area, according to job-hunting site ZipRecruiter.

    “By November 1, the jobs had plunged to 27,919 — down a third,” said the report.

    Jobs in the San Jose-Sunnyvale-Santa Clara metro area fell by a third, going from 28,421 tech job openings on January 1 to 18,748 on November 1.

    Himanshu V, an IIT-Kharagpur graduate who earlier worked at GitHub, Adobe and Flipkart, lost job at Meta.

    “I relocated to Canada to join #Meta and 2 days after joining, my journey came to an end as I am impacted by the massive layoff,” Himanshu said in a LinkedIn post.

    Raju Kadam, who worked at Meta for nine months, said he wasn’t expecting to be laid off as he had had “strong performance in all quarters” since joining the social network.

    “It abruptly came to an end. My clock to leave the USA has started today…help me find a job, otherwise I have to leave the USA with my kids,” Kadam said, posting a picture of his sons, Arjun and Yash, in the US.

    He said that he has been in the US for 16 years now and has seen the worst downturns, “but I never lost my job”.

    “I will do whatever in my power to give them the best opportunity to succeed in the USA. Hence, I need a new job in the USA ASAP,” Kadam posted on LinkedIn.
