A bench of Chief Justice DN Patel and Justice Jasmeet Singh said that they are not giving any relief to the PDP leader.
The Delhi High Court on Friday refused to stay the summons issued to the former Jammu and Kashmir Chief Minister Mehbooba Mufti by the Enforcement Directorate in the money laundering case.
A bench of Chief Justice DN Patel and Justice Jasmeet Singh said that they are not giving any relief to the PDP leader.
The court asked the ED to file a brief note on 16 April to be submitted before the next date along with a compilation of the decisions made by them.
Solicitor General Tushar Mehta, representing the ED, said the mufti is yet to appear before the authorities.
The ED, which had earlier called Ms. Mufti for March 15, was not issued summons for March 22.
The former Chief Minister of Jammu and Kashmir has been summoned for 22 March.
Senior advocate Nitya Ramakrishnan, representing Ms. Mufti, urged the court not to urge the ED for her personal appearance as it had done earlier.
To this, the bench said, “We are not giving any stay. We are not giving any relief.” Ms. Mufti has sought cancellation of the summons issued to her by the ED in the money laundering case.
It has sought to declare Section 50 of the Money Laundering Act (power to record an officer of the ED) void and inactive, which is unfairly discriminatory, a violation of safeguards and a violation of Article 20 (3) of the Constitution . It has also demanded an interim stay on the summons till the question of law is decided in relation to the constitutionality of Section 50 of the Act.
