The Ministry of Home Affairs rejected the request made under RTI, saying “there is no public interest involved”.
The Ministry of Home Affairs (MHA) has turned down a request for information under the Right to Information Act, 2005, which is under Indian Police Service (IPS) officers across the country, who have retired prematurely since 2014, They have been removed from service or removed.
The information has been denied on the grounds that “there is no public interest involved”.
Hemant Kumar, a lawyer from the Punjab and Haryana High Court, had sought information through RTI, along with the total number as well as names of all IPS officers with their state cadre, who were prematurely retired, removed, terminated. Were dismissed or rejected, etc. All India Services ie – IPS, from May 2014 till now ie till disposal of this RTI application.
In response to the application, MHA stated on 11 March, “It has been stated that there is no public interest involved in providing the information. Thus, the information sought cannot be provided under Section 8 (1) (j) of the RTI Act, 2005.
Mr. Kumar had also sought to know the total number as well as the name along with the state cadres of all the IPS officers against whom prosecution has been approved by the MHA to all state governments, special courts etc. from May 2014 onwards. Till today.
Also, the applicant sought information on the total number of state cadres of all IPS officers as well as those officers who are on suspension.
Dissatisfied with the response, Mr. Kumar stated that when section 8 (1) (j) of the RTI Act, 2005, which the CPIO (Central Public Information Officer) refused to give information to him, himself mentioned that The information, which would not be denied to Parliament or the state legislature, would not be denied to anyone, how the Ministry of Home Affairs had denied the information it required, and also said that there was no public interest involved.
Mr. Kumar stated that in 2017, he had asked for similar information and on 22 September 2017, the MHA responded to him. “I failed to understand how the parameter of ‘public interest’ has changed now,” he said.
