Courts should be vigilant against excesses of Parliament: Judge

Justice Rohinton Nariman, Judge, Supreme Court also said on Saturday that the courts are always vigilant and control any excesses committed by Parliament.

Delivering the Makenhambir Memorial Lecture on virtual mode on the First Amendment of the Indian Constitution organized by the School of Law, Sastra Deemed University, Justice Nariman said the courts would be vigilant.

Emphasizing the prohibition of Fundamental Rights, Justice Nariman traced the constitutional visit to Articles 19, 21, 22, 31 (a) and (b) and 46.

Recalling Makenambir’s efforts in the famous Ekagopalan and Golaknath cases before the Supreme Court, he told the audience how his pleas had the legal foresight that set the way for defending the basic structure of the Constitution in the Kesavanand Bharati case.

Justice Nariman also launched the CS Vaidyanathan Chair on Law and Development, established in the school of law, SASTRA, with the support of Senior Advocate CS Vaidyanathan, who explained the origin and purpose of the Chair.

Presiding over the event, the former Chief Justice of India, Justice MN Venkatachalaiah called upon the students of Sastra Law School to study the nuanced relationship between law and socio-economic development.

Attorney General KK Venugopal, former Attorney General and Senior Advocate, K. Parasaran, and the grandson of Nambeer, Advocate General of Tamil Nadu, Vijay Narayan and Vice Chancellor of SASTRA S. SaeedShayasubrahmanyam, participated in the program according to a SASTRA press release.
