The Kerala High Court on Friday directed the Central Bureau of Investigation (CBI) to investigate the deaths of two minor girls at Valayar in Palakkad district.

It did not present a copy of the FIR, the results of the police investigation, the reasons for referring the case to the CBI, among other details. As per the Central Government guidelines, the State Government had to provide such details so that it could take a decision on the request of the Government. The girls’ mother said there was a delay in the investigation by the CBI. However, when the petition came up for hearing, the government submitted that both the deaths would be investigated by the CBI.

Two girls, aged 13 and nine, were found dead inside their one room house in Valayar for 52 days apart. The 13-year-old girl was found hanged on January 13, 2017, while her sister, a nine-year-old, committed suicide on March 4 in the same house. The crime branch had investigated the cases and arrested four people. The two accused in the case, Valya Madhu and Kutti Madhu, are close relatives of the girls’ mother, while another accused Shibu is a former co-worker of her parents. Later, the special court of POCSO cases acquitted all the accused arrested in the case on the grounds that the prosecution failed miserably to prove the case against them.

However, the High Court set aside the acquittal and sent the case back for a new trial. The High Court had also clarified that the prosecution can also file a petition before the special court for a further inquiry if necessary. The prosecution later filed a petition before the special court for a further investigation into the case. Meanwhile, the government had decided to hand over the investigation to the CBI after publicly resenting the failure of the prosecution.
