The Kerala High Court has held that while making appointments to temporary posts of university assistants, either through contractual appointment or on a daily salary basis, the candidates included in the rank lists prepared by the Public Service Commission (PSC) for the posts sanctioned to the universities Should be given priority. The court made it clear that the notifications calling applicants for such temporary posts should clearly indicate that proper preference would be given to the candidates included in the current rank list.
The court ordered that they would not have any claim on the basis of any regularization or such engagement on a permanent basis.

The orders were passed on appeal by CV Biju of Kottattukulam, who was included in the rank list prepared by the PSC for appointment to the post of university assistants in various universities. He challenged contractual appointments to the post of assistants in universities. He argued that although there was a valid rank list, the Cochin University of Science and Technology (QSAT) created 42 temporary posts of university assistants. This appeal was against the single judge’s decision in which his petition was dismissed.
The list ran out
The court stated that the rank list which had been received by the petitioner had already expired. However, some temporary posts of university assistants were created when the rank list was valid. The University took the stand that the appointment through PSC was applicable only to the sanctioned posts and the temporary posts were filled through contract appointments.
The court also directed the university to adjust the petitioner to a temporary vacancy, which would arise on or after April 21, 2021 at the university.
