The Supreme Court on Friday asked the Tamil Nadu Police to respond to an appeal by DMK MP RS Bharti to file a criminal case against him for making derogatory remarks against the Scheduled Caste community.
The Madras High Court on 22 February refused to quash the case. Justice L. A bench headed by Nageswara Rao issued notice to the Crime Branch assistant police commissioner and complainant Kalyan Sundaram, leader of Athi Tamler Makkal Bachhi. They have to give their responses in a fortnight.
In proceedings conducted through video-conferencing, the bench sought a response on the petition within two weeks.
“The contents of Section 3 (1) (u) of SC / ST (Prevention of Atrocities) Act, 1989 are not complete. For an offense to be committed under section 3 (1) (u) of the Act, the speaker is required to promote or promote feelings of enmity, hatred or ill will against members of the Scheduled Castes or Scheduled Tribes. The petition was filed through advocate Amit Anand Tiwari.
The petitioner stated that the “Dravidian Progressive Movement” is only the historical fact with which it has been involved since 1960, that Tamil Nadu has improved and uplifted the lives of members of SC, ST and Dalit communities. “
